Terms of Service (TOS)

These Terms of Service (“Terms”) govern your access to and use of Domz (the “Platform”), operated by Domz.com LLC, a limited liability company organized under the laws of the State of New Jersey (“Domz,” “we,” “us,” or “our”). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not access or use the Platform.

Domz is a directory and communication platform that enables domain name buyers and sellers to discover listings and communicate directly.

Domz does not act as a broker, escrow agent, marketplace, or intermediary. Domz does not participate in negotiations, process payments, hold funds, facilitate or execute domain transfers, provide legal, financial, or transactional advice, or verify ownership, authority, or intent of any user.

All transactions, negotiations, payments, transfers, and agreements occur entirely outside the Platform and are the sole responsibility of the participating users.

You must be at least 18 years old and legally capable of entering binding agreements to use the Platform.

You are responsible for maintaining the confidentiality of your account credentials, all activity conducted through your account, and ensuring that all information you provide is accurate and current.

Domz reserves the right to refuse service, suspend, restrict, or terminate access to the Platform at any time, for any reason, with or without notice, in its sole discretion.

By submitting a listing or other content, you represent and warrant that you have the legal right and authority to list the domain, that the domain is not stolen, disputed, or unlawfully controlled, and that the linked landing page accurately represents the domain’s availability.

Listings must link directly to a domain-specific landing page and must clearly indicate that the domain is for sale, such as Buy Now, Make Offer, or Request Price.

Users are responsible for promptly updating or removing listings if a domain is sold or no longer available.

Domz reserves the right to review, remove, or delist any content at its discretion, without obligation to provide notice or explanation.

Domz does not participate in or oversee any transaction, including price determination, negotiations, selection of escrow or payment methods, payment processing, domain transfers, or dispute resolution.

Users are solely responsible for conducting due diligence and determining whether and how to complete any transaction.

You agree not to use the Platform to engage in fraud, phishing, deception, or malicious activity; impersonate another individual or entity; list domain names you do not own or control; introduce malware, scripts, or harmful code; scrape, harvest, or collect data from the Platform for competitive or commercial use without authorization; or circumvent, disable, or interfere with Platform security or functionality.

Domz reserves the right to investigate violations and take appropriate action, including suspension or termination of access.

Subscription fees grant access to Platform features only.

Domz charges no commissions on transactions and does not receive any portion of transaction proceeds. Subscription fees are non-refundable unless otherwise stated. Plan upgrades may be subject to prorated adjustments.

Payments are processed by third-party payment providers. Domz does not store or have access to payment credentials. Fraudulent chargebacks or payment disputes may result in suspension or termination of access.

The Platform may contain links to third-party websites or services, including landing pages, escrow providers, or other tools.

Domz does not endorse or control third-party services and is not responsible for their content, performance, security, or terms. Domz assumes no liability for losses arising from third-party interactions. Use of third-party services is at your own risk.

You acknowledge and agree that buying and selling domain names involves inherent risk, that Domz does not guarantee transaction outcomes, that Domz does not verify counterparties or representations, and that you assume full responsibility for your use of the Platform.

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOMZ DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

DOMZ DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY LISTING, COMMUNICATION, OR TRANSACTION WILL RESULT IN A SUCCESSFUL OUTCOME.

To the maximum extent permitted by law, Domz.com LLC, its members, managers, officers, employees, and agents, shall not be liable for financial losses or lost profits, failed or disputed transactions, fraud, misrepresentation, or misconduct by users, domain ownership disputes, data loss or service interruptions, or indirect, incidental, or consequential damages.

Your sole remedy for dissatisfaction with the Platform is to discontinue use.

You agree to indemnify, defend, and hold harmless Domz.com LLC, its members, managers, officers, employees, and agents, from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising from your use of the Platform, your listings or communications, any transaction you engage in, or your violation of these Terms.

The Platform, including its design, layout, software, branding, and proprietary content, excluding user-submitted listings, is owned by Domz.com LLC and protected by applicable intellectual property laws.

Users retain ownership of their domain names and listing content. No rights are granted to users to copy, modify, distribute, or exploit the Platform’s proprietary elements without prior written consent.

Domz may suspend or terminate access to the Platform at any time, for any reason, without liability.

You may terminate your account at any time. Subscription access continues through the applicable billing period unless the account is deleted.

Domz may modify these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law principles. Any dispute shall be resolved exclusively in the state or federal courts located within the State of New Jersey.

YOU AND DOMZ AGREE THAT EACH MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION.
